The following is an actual case example of how one of our experienced DUI attorneys was able to protect the rights of one of our clients...

A police officer testified in a DUI trial as to what he observed prior to curbing the defendant's vehicle.

He testified that he saw the defendant in a red Oldsmobile traveling "at a high rate of speed," and recorded the license plate number.

He claimed to have followed the red Oldsmobile for a couple of city blocks and said that the vehicle swerved, on one occasion, out of the lane it was in.

The officer then testified that he continued to follow the defendant, only to see him swerve out of his lane on at least two more occasions, at which point the officer pulled the defendant over and arrested him for DUI, with no field sobriety tests being given. No other witnesses were introduced at trial.

After a rigorous cross examination, defense counsel argued that the officer was, at best, incompetent for not curbing the defendant immediately when he saw his car speeding and swerving out of his lane. At worst, the officer was not telling the truth.

The judge found the defendant Not Guilty after cross examination and arguments by counsel for the defense. A violation of supervision on a prior DUI was also dismissed, as a result of the defense victory.
